Multiple TopGolf customers have suffered severe eye injuries during nights out at TopGolf locations. Some of these victims have even permanently lost their eyes because of the severity of their injuries.
There have been at least two customers who have lost eyes at the Dallas TopGolf location.
In one case, Cooper Brown was enjoying a TopGolf outing with friends in Dallas when the night took an abruptly catastrophic turn. An allegedly drunken fellow TopGolf patron allegedly hit a ball that landed in Cooper’s right eye, blinding him in that eye. He has now replaced his right eye with a prosthetic one.
In 2013, another Dallas TopGolf customer lost her eye in an accident involving another customer at TopGolf. Rebecca Brown says that she was sitting at a table when another allegedly drunk customer hit a ball backward and into her eye. Like Cooper, she too lost her eye due to how severely it was damaged and now wears a prosthetic.
There is at least one other eye injury case at TopGolf, in which a woman lost her eye when her friend swung his club backward and struck her.
We are aware of at least four people who have been injured in falls at TopGolf locations:
In Essex, England, a man suffered severe facial injuries during a fight with two other men at a TopGolf location in June of 2019. The fight broke out following an argument and spilled outside of the location. A 21-year-old man and a 24-year-old man were both charged.
While specific details regarding the fight are not available, our lawyers believe there is a significant chance that alcohol was involved. Excessive drinking is very common during TopGolf outings, which can often lead to short tempers and physical fights.
In our legal opinion, TopGolf has failed to do everything in their power to prevent serious injuries to their customers. There are some aspects of the TopGolf experience which we believe have left customers vulnerable to suffering preventable injuries:
Binge drinking is extremely common and arguably even encouraged at TopGolf. TopGolf is supposed to be a more exciting and fun alternative to a traditional golf course, and the business markets food and alcoholic beverages as part of the experience. Several TopGolf locations even have multiple bars on site.
Customers are frequently drunk while swinging clubs and hitting balls, which has led to customers getting injured by flying balls or golf clubs that customers have lost their grip on. Alcohol can also cause short tempers in some people, which can lead to serious injuries suffered when physical fights break out.
Businesses have a legal duty to make sure their customers are safe from preventable dangers. When a customer suffers a serious injury due to unsafe conditions at a business, that customer may have grounds for a lawsuit against the business under a legal concept known as premises liability.
