What is the TCPA?

The Telephone Consumer Protection Act (TCPA), a federal law, was enacted in 1991 to protect consumers from the growing number of unsolicited telephone calls. Since then, the law has been amended multiple times and has been expanded to include unwanted text messages. While the law is not meant to protect consumers from every form of communication, it does protect consumers from some of the most common types of harassment and telemarketing scams.

The TCPA covers two types of violations:

Unwanted Calls

Under the TCPA, a call is considered unwanted if it is made using an automatic telephone dialing system or prerecorded messages.

False Statements

The TCPA also protects against false statements made by telemarketers. For instance, if a telemarketer tells you that he has been selected for a job offer, but doesn’t actually tell you anything about the company, that would violate the TCPA.

How Does the Telephone Consumer Protection Act Help?

The TCPA is administered by the FCC and provides for the enforcement of the law. The law is designed to prevent individuals from receiving calls that they did not request. It requires that each person who receives a telephone call have the option to refuse to receive any further calls from the same entity. The law also prohibits entities from using automatic dialing equipment to call numbers without the prior express consent of the recipient.

The law is enforced through the Federal Trade Commission (FTC). The FTC can take action against any person or business that violates the law.

Does Pennsylvania Have State Laws For Robocalls?

Pennsylvania has some of the toughest laws regarding telemarketing and robocalls in the country. The Telephone Consumer Protection Act (TCPA) was enacted in 1991 and prohibits unsolicited commercial calls. However, this law is not well-enforced and it is quite easy for robocallers to operate in Pennsylvania.

The Federal Trade Commission has the authority to fine or shut down any business that violates the TCPA. However, the FTC does not have the resources to monitor or enforce the law on a nationwide level and has a backlog of cases. The FTC does not accept complaints over the phone and must be filed in federal district court.

What is the Do Not Call Registry?

There is a national Do Not Call registry that you can use to register your phone number. If you do not want to receive telemarketing calls, you can register your phone number with the national Do Not Call registry. Phone numbers entered into the registry should not be solicited by an automated telephone dialing system and should eliminate nearly all automated calls. Mobile phones that continue to receive these prerecorded or artificial voice calls may be entitled to compensation.

There are a number of other laws in Pennsylvania that protect consumers from robocallers. One example is the Telephone Consumer Protection Act of 1991 (TCPA). The TCPA prohibits the use of automated dialing systems to make telephone calls to people who have not given prior express consent. The law applies to any person who uses an automatic dialing system to make calls from a cellular or wireless telephone.
